Common use of Nature of Counterparties Clause in Contracts

Nature of Counterparties. You represent, warrant and undertake on your own behalf and as agent for the Counterparties that no Counterparty will be a state or a separate entity within the meaning of the Xxxxx Xxxxxxxx Xxx 0000 and that a Counterparty shall, at the time an instruction is given in respect of it, have the characteristics and conform to any criteria agreed between us from time to time.
