Common use of Mutilated, Destroyed, Lost or Stolen Equipment Notes Clause in Contracts

Mutilated, Destroyed, Lost or Stolen Equipment Notes. If any Equipment Note becomes mutilated, destroyed, lost or stolen, the Company shall, upon the written request of the holder of such Equipment Note and subject to satisfaction of this Section 2.08 and of Section 2.09, execute and the Loan Trustee shall authenticate and deliver in replacement thereof a new Equipment Note of the same Series, payable in the same principal amount, dated the same date and captioned as issued in connection with the Aircraft. If the Equipment Note being replaced has become mutilated, such Equipment Note shall be surrendered to the Loan Trustee, and a photocopy thereof shall be furnished to the Company. If the Equipment Note being replaced has been destroyed, lost or stolen, the holder of such Equipment Note shall furnish to the Company and the Loan Trustee such security or indemnity as may be required by them to save the Company and the Loan Trustee harmless and evidence satisfactory to the Company and the Loan Trustee of the destruction, loss or theft of such Equipment Note and of the ownership thereof.

If the Equipment Note being replaced has become mutilated, such Equipment Note shall be surrendered to the Loan Indenture Trustee, and a photocopy thereof shall be furnished to the Company. If the Equipment Note being replaced has been destroyed, lost or stolen, the holder Noteholder of such Equipment Note shall furnish to the Company Owner and the Loan Indenture Trustee such security or indemnity as may be required by them it to save the Company Owner and the Loan Indenture Trustee harmless and evidence satisfactory to the Company Owner and the Loan Indenture Trustee of the destruction, loss or theft of such Equipment Note and of the ownership thereof.
