Common use of Minimum Break Clause in Contracts

Minimum Break. a) Employees are entitled to a ten (10) hour break between completion of work and the commencement of their next shift. b) The employee is to be released from duty for such time as the employee has had ten (10) hours off duty. Where this cannot occur due to exceptional circumstances, the employee is to be paid at double the ordinary rate until a ten (10) hour break can be taken. c) Health and safety will be the prime consideration in determining whether the employee is to attend work without a ten (10) hour break. d) In the case of employees whose shift roster includes the working of twelve (12) hour shifts, those employees must have a minimum of a ten (10) hour break.
