Common use of MEDIATION AND/OR ARBITRATION Clause in Contracts

MEDIATION AND/OR ARBITRATION. 16.8 In the event that the Association is not satisfied with the written response by the Superintendent/Designate, or within ten (10) operational days from the date the Superintendent/Designate response was to be delivered, the Association may refer the matter to Mediation and/or Arbitration as per section 138 of the Alberta Labour Relations Code, Chapter L.1, 2000 (providing for a three person Board). The Association and the School Division may, by mutual agreement, agree to proceed with an Arbitration Board composed of a single arbitrator rather than a three person Arbitration Board.
