Common use of MASTER CONTRACT Clause in Contracts

MASTER CONTRACT. This Master Contract is entered into this 1st day of July, 2014, between Westlake Charter Schools (hereinafter referred to as “LEA”) and CARE Educational Services (hereinafter referred to as “CONTRACTOR”) for the purpose of providing special education and/or related services to LEA students with exceptional needs under the authorization of California Education Code sections 56157, 56361 and 56365 et seq. and Title 5 of the California Code of Regulations section 3000 et seq., AB490 (Chapter 862, Statutes of 2003) and AB1858 (Chapter 914, Statutes of 2004). It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. Upon acceptance of a LEA student, CONTRACTOR shall submit to LEA an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the LEA Procedures. Unless otherwise agreed in writing, these forms shall acknowledge CONTRACTOR’s obligation to provide all services specified in the student’s Individualized Education Plan (hereinafter referred to as “IEP”). The ISA shall be executed within ninety (90) days of an LEA student’s enrollment. XXX and CONTRACTOR shall enter into an ISA for each LEA student served by CONTRACTOR. As available and appropriate, the LEA shall make available access to any electronic IEP system and /or electronic data base for ISA developing including invoicing. Unless placement is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed agreement between LEA and parent or authorized by XXX for a transfer student pursuant to California Education Code section 56325, XXX is not responsible for the costs associated with nonpublic agency placement until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency placement is appropriate, and the IEP is signed by the LEA student’s parent.

MASTER CONTRACT. This Master Contract is entered into this 1st day of July, 2014July ,2019, between Westlake Charter Schools the Capistrano Unified School District (hereinafter referred to as “District” or local educational agency “LEA”) and CARE Educational Services (hereinafter referred to as “CONTRACTOR”) for the purpose of providing special education and/or related services to LEA District students with exceptional needs under the authorization of California Education Code sections 56157, 56361 and 56365 et seq. and Title 5 of the California Code of Regulations section 3000 et seq., AB490 (Chapter 862, Statutes of 2003) and AB1858 (Chapter 914, Statutes of 2004). It is understood that this agreement Agreement, does not commit LEA the District to pay for special education and/or related services provided to any LEA District student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. Upon acceptance of a LEA student, CONTRACTOR LEA shall submit to LEA CONTRACTOR an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the LEA Procedures). Unless otherwise agreed in writing, these forms the ISA shall acknowledge CONTRACTOR’s obligation to provide all services specified in the student’s Individualized Education Plan (hereinafter referred to as “IEP”). The ISA shall be executed within ninety (90) days of an LEA student’s enrollment. XXX LEA and CONTRACTOR shall enter into an ISA for each LEA student served by CONTRACTOR. As available and appropriate, the LEA shall make available access to any electronic IEP system and /or electronic data base for ISA developing including invoicing. Unless placement is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed agreement between LEA and parent or parent, authorized by XXX LEA for a transfer student pursuant to California Education Code section 56325, XXX or otherwise authorized by LEA without a signed IEP, LEA is not responsible for the costs associated with nonpublic agency school placement until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency school placement is appropriate, and the IEP is signed by the LEA student’s parent.

MASTER CONTRACT. This Master Contract is entered into this 1st 5th day of JulyJune, 20142019, between Westlake Charter Schools the Xxxxx Unified School District (district, county office of education, a charter school participating as a member of the special education local plan area, or special education local plan area) , county of San Xxxxxxx hereinafter referred to as “the local educational agency ("LEA”") and CARE Educational Sierra Vista Child & Family Services (nonpublic, nonsectarian school or agency), hereinafter referred to as NPS/A or “CONTRACTOR”) ” for the purpose of providing special education and/or related services to LEA students with exceptional needs under the authorization of California Education Code sections 56157, 56361 and 56365 et seq. and Title 5 of the California Code of Regulations section 3000 et seq., AB490 (Chapter 862, Statutes of 2003) and AB1858 (Chapter 914, Statutes of 2004). It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. As available and appropriate, the LEA shall make available access to any electronic IEP system and /or and/or electronic data base database for ISA developing development, including invoicing. Unless placement and/or services is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed settlement agreement between LEA and parent or authorized by XXX for a transfer student pursuant to California Education Code section 56325, XXX is not responsible for the costs associated with nonpublic agency NPS placement or NPS/A services until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency NPS placement is appropriate, and the IEP is signed by the LEA student’s parent.

MASTER CONTRACT. It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. Unless placement and/or services is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed agreement between LEA and parent or parent, authorized by XXX for a transfer student pursuant to California Education Code section 56325, or otherwise authorized by XXX without a signed IEP, LEA is not responsible for the costs associated with nonpublic school placement or nonpublic agency placement services until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic school placement or nonpublic agency placement services is appropriate, and the IEP is signed by the LEA student’s parent.

It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. The ISA shall be executed within ninety (90) days of an LEA a student’s enrollment. XXX and CONTRACTOR shall enter into an ISA for each LEA student served by CONTRACTOR. As available and appropriate, the LEA shall make available access to any electronic IEP system and/or electronic database for the development of the ISA and /or electronic data base for ISA developing including invoicinginvoices. Unless placement and/or services is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed settlement agreement between LEA and parent or authorized by XXX for a transfer student pursuant to California Education Code section 56325, XXX is not responsible for the costs associated with nonpublic agency NPS placement or NPS/A services until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency NPS placement is appropriate, and the IEP is signed by the LEA student’s parent.

MASTER CONTRACT. It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. Upon acceptance of a LEA student, CONTRACTOR XXX shall submit to LEA CONTRACTOR an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the LEA Proceduresprocedures. MASTER CONTRACT. This Master Contract is entered into this 1st day of July, 20142018, between Westlake Charter Schools the Ventura County Special Education Local Plan Area (SELPA) hereinafter referred to as SELPA and the Ventura County Office of Education (VCOE) the Administrative Unit for the SELPA on behalf of the twenty-one school districts listed above (hereinafter referred to as LEA/LEAs) and Protocol Agency Inc. (hereinafter referred to as “LEA”) and CARE Educational Services (hereinafter referred to as NPS/A” or “CONTRACTOR”) for the purpose of providing special education and/or related services Related Services to LEA students with exceptional needs under the authorization of California Education Code sections 56157, 56361 and 56365 et seq. and Title 5 of the California Code of Regulations section 3000 et seq., AB490 AB 490 (Chapter 862, Statutes of 2003) and AB1858 AB 1858 (Chapter 914, Statutes of 2004). It is understood that this agreement does not commit LEA any Local Education Agency (LEA) to pay for special education and/or related services Related Services provided to any LEA student, or CONTRACTOR to provide such special education and/or related servicesRelated Services, unless and until an authorized LEA representative approves the provision of special education and/or related services Related Services by CONTRACTOR. Upon CONTRACTOR acceptance of a LEA student, CONTRACTOR the LEA shall submit to LEA develop an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the LEA Procedures). Unless otherwise agreed in writing, these forms this form shall acknowledge the CONTRACTOR’s ’S obligation to provide all services specified in the student’s Individualized Education Plan (hereinafter referred to as “IEP”). The ISA shall be executed within ninety (90) days of an LEA student’s enrollment. XXX and CONTRACTOR shall enter into an ISA for each LEA student served by CONTRACTOR. As available and appropriate, the LEA shall make available access to any electronic IEP system and /or electronic data base for ISA developing including invoicing. Unless placement is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, order or a lawfully executed agreement between LEA and parent or authorized by XXX for a transfer student pursuant to California Education Code section 56325parent, XXX is not responsible for the costs associated with nonpublic agency school placement until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency school placement is appropriate, and the IEP is signed by the LEA student’s parent evidencing the parent’s agreement to the IEP. CONTRACTOR shall not admit a student living within the jurisdictional boundaries of the LEA on a “private pay or tuition free scholarship” basis and concurrently or subsequently advise, actively support or request parent(s) to pursue funding for the admitted school year from the LEA through due process proceedings.

It is understood that this agreement does not commit LEA Shasta SELPA/District of Residence to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA Shasta SELPA/District of Residence representative approves the provision of special education and/or related services by CONTRACTOR. Upon acceptance of a LEA student, CONTRACTOR Shasta SELPA/District of Residence shall submit to LEA CONTRACTOR an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student student Enrollment form as specified in the LEA Shasta SELPA/District of Residence Procedures. Unless otherwise agreed in writing, these forms shall acknowledge CONTRACTOR’s obligation to provide all services specified in the student’s Individualized Education Plan (hereinafter referred to as “IEP”). The ISA shall be executed within ninety (90) days of an LEA a student’s enrollment. As available and appropriate, the LEA Shasta SELPA/District of Residence shall make available access to any electronic IEP system and /or electronic data base for ISA developing including invoicing. Unless placement is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed agreement between LEA Shasta SELPA/District of Residence and parent or authorized by XXX Shasta SELPA/District of Residence for a transfer student pursuant to California Education Code section 56325, XXX Shasta SELPA/District of Residence is not responsible for the costs associated with nonpublic agency school placement until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency school placement is appropriate, and the IEP is signed by the LEA student’s parent.

MASTER CONTRACT. This Master Contract is entered into this 1st day of July, 20142019, between Westlake Charter Schools the Xxxxx Unified School District (district, county office of education, a charter school participating as a member of the special education local plan area, or special education local plan area) , county of San Xxxxxxx hereinafter referred to as “the local educational agency ("LEA”") and CARE Educational Services Central Valley Training Center (CVTC) (nonpublic, nonsectarian school or agency), hereinafter referred to as NPS/A or “CONTRACTOR”) ” for the purpose of providing special education and/or related services to LEA students with exceptional needs under the authorization of California Education Code sections 56157, 56361 and 56365 et seq. and Title 5 of the California Code of Regulations section 3000 et seq., AB490 (Chapter 862, Statutes of 2003) and AB1858 (Chapter 914, Statutes of 2004). It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. Upon acceptance of a LEA student, CONTRACTOR XXX shall submit to LEA CONTRACTOR an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the LEA Procedures. It is understood that this agreement does not commit the LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. Upon acceptance of a LEA student, CONTRACTOR XXX shall submit to LEA CONTRACTOR an Individual Services Service Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the LEA Procedures). As available and appropriate, the LEA shall make available access to any electronic IEP system and/or electronic database for the development of the ISA and /or electronic data base for ISA developing including invoicinginvoices. Unless placement and/or services is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed settlement agreement between LEA and parent or authorized by XXX for a transfer student pursuant to California Education Code section 56325, XXX is not responsible for the costs associated with nonpublic agency NPS placement or NPS/A services until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency NPS placement is appropriate, and the IEP is signed by the LEA student’s parent.

It is understood that this agreement Agreement, does not commit LEA the District to pay for special education and/or related services provided to any LEA District student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. Unless otherwise agreed in writing, these forms shall acknowledge CONTRACTOR’s obligation to provide all relevant services specified in the student’s Individualized Education Plan Program (hereinafter referred to as “IEP”). The ISA shall be executed within ninety (90) days of an LEA a student’s enrollment. XXX and CONTRACTOR shall enter into an ISA for each LEA student served by CONTRACTOR. As available and appropriate, the LEA shall make available access to any electronic IEP system and /or electronic data base for ISA developing including invoicing. Unless placement is and/or services are made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed settlement agreement between LEA and parent or authorized by XXX for a transfer student pursuant to California Education Code section 56325, XXX is not responsible for the costs associated with nonpublic agency NPS placement or NPS/A services until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency an NPS placement is appropriate, and the IEP is signed by the LEA student’s parent.

MASTER CONTRACT. This Master Contract (or “Contract”) is entered into this 1st day of Julyon January 25th, 20142023, between Westlake Charter Schools (Gold Trail Union School District hereinafter referred to as “the local educational agency ("LEA”) "), a member of the El Dorado County SELPA and CARE Educational AxIS, Applied Integrated Services . This Master Contract ( or “Contract”) is entered into this 1st day of JulyJuly , 20142021, between Westlake Charter Schools the Xxxxx Unified School District (district, county office of education, a charter school participating as a member of the special education local plan area, or special education local plan area) , county of San Xxxxxxx hereinafter referred to as “the local educational agency ("LEA”") and CARE Educational Services Valley Community Counseling (nonpublic, nonsectarian school or agency), hereinafter referred to as NPS/A or “CONTRACTOR”) ” for the purpose of providing special education and/or related services to LEA students with exceptional needs under the authorization of California Education Code sections 56157, 56361 and 56365 et seq. and Title 5 of the California Code of Regulations section 3000 et seq., AB490 (Chapter 862, Statutes of 2003) and AB1858 (Chapter 914, Statutes of 2004). It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. Upon acceptance of a LEA student, CONTRACTOR XXX shall submit to LEA CONTRACTOR an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the LEA Proceduresprocedures. Unless otherwise agreed in writing, these forms shall acknowledge CONTRACTOR’s obligation to provide all relevant services specified in the student’s Individualized Education Plan Program (hereinafter referred to as “IEP”). The ISA shall be executed within ninety (90) days of an LEA a student’s enrollment. XXX and CONTRACTOR shall enter into an ISA for each LEA student served by CONTRACTOR. As available and appropriate, the LEA shall make available access to any electronic IEP system and /or electronic data base for ISA developing including invoicing. Unless placement is and/or services are made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed settlement agreement between LEA and parent or authorized by XXX for a transfer student pursuant to California Education Code section 56325, XXX is not responsible for the costs associated with nonpublic agency NPS placement or NPS/A services until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency an NPS placement is appropriate, and the IEP is signed by the LEA student’s parent.

This Master Contract is entered into this 1st day of Julyon July 1, 20142019, between Westlake Charter Schools San Mateo County Special Education Local Plan Area (hereinafter referred to as “LEA”the "SELPA") on behalf of member LEAs and CARE Educational Services _ (nonpublic, nonsectarian school or agency), hereinafter referred to as the “NPS” or “NPA”, as the case may be, or “CONTRACTOR”) ” for the purpose of providing special education and/or related services to LEA students with exceptional needs under the authorization of California Education Code sections 56157, 56361 56361, and 56365 56365, et seq. ., and Title 5 of the California Code of Regulations section 3000 3000, et seq., AB490 (Chapter 862, Statutes of 2003) and AB1858 (Chapter 914, Statutes of 2004). It is understood that this agreement does not commit LEA any Local Education Agency (LEA) member of the SELPA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTORCONTRACTOR as documented on an Individual Services Agreement. Upon acceptance of agreement that CONTRACTOR will provide services to a LEA student, CONTRACTOR XXX shall submit to LEA CONTRACTOR an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the SELPA and/or LEA Procedures. Unless otherwise agreed in writing, these forms shall acknowledge CONTRACTOR’s obligation to provide all services specified in the student’s Individualized Education Plan (hereinafter referred to as “IEP”). The ISA shall be executed within ninety (90) days of an LEA a student’s enrollment. XXX and CONTRACTOR shall enter into an ISA for each LEA student served by CONTRACTOR. As available and appropriate, the LEA shall make available access to any electronic IEP system and /or and/or electronic data base for ISA developing developing, including invoicing. Unless placement is made pursuant to an a binding Office of Administrative Hearings (hereinafter referred to as “OAH”) or judicial order, a lawfully executed agreement between LEA and parent or otherwise authorized by XXX for a transfer student pursuant to California Education Code section 56325, XXX is not responsible for the costs associated with nonpublic agency school placement until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency school placement is appropriate, and the IEP is signed by the LEA student’s parent.

It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR. It is understood that this agreement does not commit the LEA (District) to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA (District) representative approves the provision of special education and/or related services by CONTRACTOR. Upon acceptance of a LEA student, CONTRACTOR LEA (District) shall submit to LEA CONTRACTOR an Individual Services Agreement (hereinafter referred to as “ISA”) and a Nonpublic Services Student Enrollment form as specified in the LEA Procedures). Unless otherwise agreed in writing, these forms shall acknowledge CONTRACTOR’s obligation to provide all relevant services specified in the student’s Individualized Education Plan Program (hereinafter referred to as “IEP”). Unless placement and/or services is made pursuant to an Office of Administrative Hearings (hereinafter referred to as “OAH”) order, a lawfully executed settlement agreement between LEA (District) and parent or authorized by XXX LEA (District) for a transfer student pursuant to California Education Code section 56325, XXX LEA (District) is not responsible for the costs associated with nonpublic agency placement NPA services until the date on which an IEP team meeting is convened, the IEP team determines that a nonpublic agency placement is NPA services are appropriate, and the IEP is signed by the LEA student’s parent.

It is understood that this agreement does not commit LEA to pay for special education and/or related services provided to any LEA student, or CONTRACTOR to provide such special education and/or related services, unless and until an authorized LEA representative approves the provision of special education and/or related services by CONTRACTOR.
