The employees included in the Bargaining Unit are all employees paid an hourly rate, including students and temporary employees performing Bargaining Unit work in Transit Operations, Transit Fleet Maintenance, and Transit Capital Projects & Facilities Management Branches except managerial and clerical staff, superintendents, supervisors, uniformed bus service supervisors, salaried instructors, security personnel and newly hired employees on initial training. The Parties acknowledge that the recent changes in the organizational chart of the Transit Services Department were not intended in any way to alter or diminish the rights of employees subject to this collective agreement. B.2 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.
