Lodge Security. Section 1. Membership in the Lodge is not compulsory. Members have the right to join or not join and neither party shall exert pressure or unlawfully discriminate against a Member regarding such matters. All Members in the bargaining unit, however, shall be required to pay their fair share of the cost of representation by the Lodge, as provided by Collective Bargaining Ordinance LMCO Chapter 35.050-35.058. Section 2. Lodge Membership dues and fair share dues shall be deducted monthly in an amount certified by the Lodge. Members wishing to revoke their Lodge Membership must notify Metro Government and the Lodge expressly and individually, in writing by certified mail, within twenty (20) days following the effective date of this Agreement that such dues are not to be deducted. The fair share fee shall be deducted from Members' wages and remitted to the Lodge, with or without written authorization by the Member. The date for the commencement of the fair share deduction shall be determined by the Lodge with appropriate advance notice given to Metro Government and affected Members. Section 3. Lodge membership dues and fair share fees shall be transmitted to the Treasurer of the Lodge by the fifteenth (15th) day of the succeeding month after such deductions are made. The Lodge shall annually certify, in writing, the current and proper amount of its Membership dues or fair share fees at least thirty (30) days prior to the initial deduction. The Lodge shall notify Metro Government of the cost of representation by the Lodge and the date for the commencement of the fair share deduction at least thirty (30) days prior to the initial deduction. Section 4. Metro Government agrees to deduct from the wages of any Member, any such sums of money as requested by said Member, as long as it is a continual or regular deduction, on a form authorized by Metro Government and the Lodge. Such authorization shall be allowed in any amount certified by the Lodge or requested by the Member. Section 5. Members who are included in the collective bargaining unit but decline Membership in the Lodge shall contribute to the financial support of the Lodge by payment of a fair share fee, which shall be automatically deducted from the wages of the individual Member. Section 6. The Lodge shall hold Metro Government harmless against any claims, legal or otherwise, which may arise from these dues or fair share deduction provisions Section 7. Notwithstanding the above, the parties agree to comply with state law regarding union membership and the withholding of union dues, fees, assessments, or other similar charges.

The deductions will be made the first pay period of each month from the pay of any Lodge bargaining unit member, upon presentation to the appropriate payroll clerk of a written payroll deduction form signed by the Membermember authorizing the deduction by the Lodge member. The City shall transmit such dues deduction to the Lodge Financial Secretary on a monthly basis. The City shall be relieved from making individual dues deduction payments to the Lodge when a member: (1) resigns or is separated from City employment; (2) is laid off from City employment; (3) provides written revocation of dues deduction authorization to both the City and the Lodge; (4) is on an unpaid leave of absence when the dues deduction would otherwise be due, or (5) at any time when dues are otherwise due, fails to receive sufficient wages to make all legally required deductions in addition to the deduction of Lodge dues, provided that the member's dues shall thereafter be deducted in the first available pay period in which the member has sufficient wages to make the dues deduction in addition to all legally required deductions. Section 5. Members who are included in B. Upon the collective bargaining unit but decline Membership in Lodge's request, and subject to the City's approval, the City shall provide the Lodge shall contribute to with additional payroll deduction(s) for the financial support purpose of the Lodge by providing voluntary benefits to Lodge members. C. As a consequence of the decision in ▇▇▇▇▇ v. AFSCME, Council 31, et al. (decided June 27, 2018) the City and the Lodge have agreed to remove prior provisions pertaining to the payment of a fair share feefees by non-members; and, which shall the City and Lodge agree that fair share fees may no longer be automatically deducted from non-members’ pay. The City and the wages Lodge agree further that, in the event there are changes in the law that permit the collection of fees or other financial support from non-members of the individual MemberLodge through payroll deduction, the Lodge and the City shall enter into good faith negotiations to address and permit the collection of such fees and/or financial support through payroll deduction. Section 6. The D. Except as provided in paragraphs (A) and (B) in this Section, the Lodge shall hold Metro Government harmless against any claimsagrees that the City assumes no obligation, legal financial or otherwise, which may arise from these arising out of the provisions of this Agreement regarding the deduction of Lodge dues. Once the City remits dues or fair share deduction provisions to the Lodge each month, their disposition thereafter shall be the exclusive responsibility of the Lodge. The provisions of this Section 7. Notwithstanding are not subject to the above, the parties agree to comply with state law regarding union membership and the withholding grievance procedure set forth in Article 6 of union dues, fees, assessments, or other similar chargesthis Agreement.
