Lodge Security. All eligible employees covered by this Memorandum of Understanding (a) who are employed after July 1, 1984 and elect not to join or remain members of the Lodge or (b) who were employed prior to July 1, 1984 and had previously executed membership or dues authorization cards as members of said ▇▇▇▇▇, but hereinafter elect to terminate such membership and/or revoke said dues authorization cards, shall, as a condition of continued employment, pay a service fee to the Lodge in an amount not to exceed the then current Lodge dues in order to defray the costs incurred by the Lodge in the negotiation, administration and implementation of the terms of the Memorandum, and all modifications and amendments thereto, including related proceedings before an impasse panel or arbitrators, in the processing of grievances, and in any and all other proceedings and matters for which the Lodge is the employees' exclusive representative as a result of its certification.
Lodge Security. Section 1. Membership in the Lodge is not compulsory. Members have the right to join or not join and neither party shall exert pressure or unlawfully discriminate against a Member regarding such matters. All Members in the bargaining unit, however, shall be required to pay their fair share of the cost of representation by the Lodge, as provided by Collective Bargaining Ordinance LMCO Chapter 35.050-35.058. Section 2. Lodge Membership dues and fair share dues shall be deducted monthly in an amount certified by the Lodge. Members wishing to revoke their Lodge Membership must notify Metro Government and the Lodge expressly and individually, in writing by certified mail, within twenty (20) days following the effective date of this Agreement that such dues are not to be deducted. The fair share fee shall be deducted from Members' wages and remitted to the Lodge, with or without written authorization by the Member. The date for the commencement of the fair share deduction shall be determined by the Lodge with appropriate advance notice given to Metro Government and affected Members. Section 3. Lodge membership dues and fair share fees shall be transmitted to the Treasurer of the Lodge by the fifteenth (15th) day of the succeeding month after such deductions are made. The Lodge shall annually certify, in writing, the current and proper amount of its Membership dues or fair share fees at least thirty (30) days prior to the initial deduction. The Lodge shall notify Metro Government of the cost of representation by the Lodge and the date for the commencement of the fair share deduction at least thirty (30) days prior to the initial deduction. Section 4. Metro Government agrees to deduct from the wages of any Member, any such sums of money as requested by said Member, as long as it is a continual or regular deduction, on a form authorized by Metro Government and the Lodge. Such authorization shall be allowed in any amount certified by the Lodge or requested by the Member. Section 5. Members who are included in the collective bargaining unit but decline Membership in the Lodge shall contribute to the financial support of the Lodge by payment of a fair share fee, which shall be automatically deducted from the wages of the individual Member. Section 6. The Lodge shall hold Metro Government harmless against any claims, legal or otherwise, which may arise from these dues or fair share deduction provisions Section 7. Lodge Security. All eligible employees covered by this Agreement who are (a) employed after July 1, 2004 and elect not to join or remain members of the FOP or (b) who were employed prior to July 1, 2004 and had previously executed membership or dues authorization cards as members of said FOP, but hereafter elect to terminate such membership and/or revoke said dues authorization cards, shall, as a condition of continued employment, pay a service fee to the FOP, during the period that said FOP retains its certification, in an amount not to exceed seventy-five (75%) of the then current FOP dues in order to defray the costs incurred by the FOP in the negotiation, administration and implementation of the terms of the Agreement, and all modifications and amendments thereto, including related proceedings before an Impasse or Arbitration Panel or arbitration in the processing of grievances; in the conduct of disciplinary proceedings and in the appeal thereof; in the protection and improvement of civil service rights; and in any and all other proceedings and matters for which the FOP is the employeesexclusive representative as a result of its certification. The service fee provision as outlined herein shall apply if the FOP demonstrates that ten (10%) percent or more of the total employees eligible to be included within an appropriate unit decline to authorize dues deductions imposed by said FOP. The FOP shall indemnify and save the Employer harmless of any and all claims, grievances, actions, suits or other forms of liability or damages that arise out of or by reason of the collection and disposition of the funds deducted under this Article as soon as they have been remitted by the Employer to the FOP.

Lodge Security. The County shall not discriminate against any employee because of his/her membership in the Lodge. As a condition of continued employment, all employees in the bargaining unit shall either become and remain members in good standing of the Lodge or pay a representation fee to the Lodge which shall be less than one hundred percent (100%) of the regular monthly dues paid by Lodge members and which sum accurately represents the amount due the Lodge as said employee's fair share of the costs attributable to negotiating and enforcing terms of this Agreement. The representation fee shall not include, by way of example, but not by way of limitation, State, national, or other dues and assessments or other amounts for Lodge activities. The requirements set forth above shall become effective thirty (30) days after the effective date of this Agreement or thirty (30) days after an employee's date of employment, whichever is later. However, when an employee is in a probationary period, the Lodge may only represent said employee for hours and rates of pay and applicable fringe benefits during said probationary period. Lodge Security. As a condition of continued employment, all employees in the bargaining unit shall either become and remain members in good standing of the Lodge or pay a representation fee to. the Lodge, which shall be less than one hundred percent (100%) of the regular monthly dues paid by Lodge members and which sum shall accurately represent the amount for said employees due the Lodge as their fair share of costs attributable to the Lodge as their share of costs attributable to negotiating the terms of this Agreement, which sum shall not include, by way of example, but not by way of limitation, State, National or other dues and assessments or other amounts for Lodge activities. At the time of execution of this Agreement, the regular monthly Lodge dues are $22.50 (Jan. 86), and the representation fee is $20.50 (Jan. 86); however, the Lodge, pursuant to its Constitution and By-Laws, may raise the dues accordingly. Lodge Security. Section 1. Membership in the Lodge shall not be a condition of employment. Members have the right to join or not join the union. Pursuant to KRS 67A.6902(3), the Lodge shall represent all Members without discrimination regardless of union membership. Section 2. L.F.U.C.G. shall not restrain or discourage membership in the Lodge. L.F.U.C.G. shall not discriminate against any Member because of activities protected under KRS 67A.6901 et seq. Section 3. All Members may join Lodge membership or withdraw therefrom via written notice served upon L.F.U.C.G. and the Lodge. Section 4. All Members holding membership with the Lodge shall pay union dues through regular payroll deductions each calendar month. Before L.F.U.C.G. initiates the first payroll deduction, each member shall provide express written authorization, on a form authorized by L.F.U.C.G. and the Lodge, signed by the Member from whose pay the dues will be deducted (“Membership Notice”). Once a Member authorizes the deduction, L.F.U.C.G. shall begin payroll deductions as soon as practical but in no event later than the second (2nd) pay period following receipt of the Membership Notice. L.F.U.C.G. shall continue payroll deductions until a Member revokes consent via written notice served upon L.F.U.C.G. and the Lodge. Section 5. L.F.U.C.G. shall deduct from payroll the monthly amount of union dues in the second (2nd) pay period of each calendar month. L.F.U.C.G. shall deliver such amount to the Treasurer of the Lodge by the fifteenth (15th) day of the succeeding calendar month after such deductions are made.
