Local Access Clause Samples
The Local Access clause defines the rights and limitations regarding a party's ability to physically or digitally access a specific location, system, or resource within a defined geographic area. Typically, this clause outlines who may enter or use the premises or network, under what conditions, and for what purposes—such as for maintenance, inspections, or service delivery. Its core function is to ensure that access is controlled and authorized, thereby protecting the security and integrity of the location or system while facilitating necessary operations.
Local Access. If pursuant to an applicable Service Order the parties agree, then BluIP shall provide circuits, or other installation in connection with local channel access, required for local access to the designated building point of demarcation, or such other points agreed by the parties and achievable by the service provider. After the effective date of a Service Order, Customer may be notified that “special construction and/or additional access charges” apply because, for example, the access service provider must install special equipment or incur unusual expenses to establish Service. Facilities construction relating to special construction and/or additional access charges will not begin until Customer has agreed in writing to pay the such charges. If Customer does not timely authorize the special construction, then the applicable Service Order will be cancelled and Customer shall pay to BluIP “Two-Day Cancellation Fees” (defined under the below Section “Termination/Remedies”). In any event, Customer is responsible for the installation, maintenance, and warranty of circuit extension work or line extensions (e. g., beyond the point of demarcation), and any charges associated with such circuit extension work or line extensions, access, usage and maintenance of telecom lines.
Local Access. Dedicated E-Line SLA covers all Platinum, Gold, Silver and Bronze access.
Local Access. Local Access is provided to Customer subject to the third party provider’s terms and conditions, including any installation or operation permits, permissions or ‘No Objection Certificate’ requirements, minimum service terms and cancellation fees. Orixcom may require Customer to sign the Local Access service documentation and/or appoint Orixcom as its agent to do same and/or to receive Local Access service correspondence on Customer’s behalf. Unless otherwise indicated on the Service Order, Orixcom does not proactively monitor or manage Local Access.
Local Access. Pricing for Local Access is determined in accordance with the terms and conditions set forth in applicable Alliance Agreements.
Local Access. Local Access is required for Internet Dedicated Service and is provided via the terms and conditions of the Verizon Local Access service attachment unless Customer requests (and Verizon approves) that Customer order its Local Access lines.
Local Access. Subject to any existing contractual obligations of Will▇▇▇▇ ▇▇ its Affiliates' with third parties, if an SBC Affiliate providing local exchange services (an "SBC ILEC") is available to provide local access (including switching and local transport), then in such SBC ILEC's territory:
3.8.1. SBC may designate its local access provider of choice for (i) any local access service used exclusively for traffic originated by SBC or its customers; or (ii) any trunk group carrying switched voice traffic where SBC (including its customers) provides 75% or more of the minutes of use carried by such trunk group. It is anticipated, but not required, that in the ordinary course SBC will designate the SBC ILEC for use by Will▇▇▇▇ ▇▇ long as such SBC ILEC has network capacity available. However, nothing herein shall in any way prevent SBC from designating another local access provider.
3.8.2. In all other circumstances Will▇▇▇▇ ▇▇▇ll use local access services provided by an SBC ILEC unless either (i) that ILEC's tariffed rate or other legally permissible price for such access product is greater than the Alliance Price for such access services; or (ii) the access service is used exclusively for traffic originated by a party other than SBC or its customers and that party specifically requests the use of another access provider.
3.8.3. Will▇▇▇▇ ▇▇▇l enter into separately negotiated agreements with each SBC ILEC that, subject to all applicable regulatory requirements, will permit Will▇▇▇▇ ▇▇ meet its commitments hereunder.
Local Access. (i) The Grantor shall, on behalf of and upon the request of the Purchaser, obtain telecommunications facilities connecting a Grantor POP to a designated customer of the Purchaser or other third-party ("Local Access"). As applicable, the Purchaser will execute a Letter of Agency authorizing the Grantor to interact directly with the provider or providers of such Local Access. The Purchaser shall be responsible for all fees and costs ------ **** Confidential material has been omitted and filed separately with the Securities and Exchange Commission.
Local Access. If local access is ordered in connection with the Service, SAVVIS will order and administer such local access on Customer’s behalf from the local access provider of SAVVIS’ choice. SAVVIS reserves the right to change the local access provider in its sole and reasonable discretion. If Customer acquires its own local access for use with the Service, Customer is solely responsible for coordination of all such local access and for any costs (including early termination fees) associated with such local access. Customer shall indemnify, defend and hold SAVVIS and its affiliates harmless from any and all third party claims, losses, damages, liabilities, costs and expenses, including, without limitation, reasonable attorney’s fees and court costs, arising from or related to local access used by Customer in connection with Service.
Local Access. When Local Access is to be provided, and Orixcom is not the Provisioning Entity, Orixcom will order the Local Access and Customer agrees to pay to Orixcom all Charges associated with the Local Access (including any Orixcom charges for administration), Local Access is provided to Customer subject to the applicable terms and conditions of use (including any applicable service term and cancellation fees) of the third party provider of the Local Access. Installation may be scheduled during the period notified by Orixcom and if Customer requires installation outside of this period Orixcom may charge reasonable additional fees. Any facilities and extra cabling necessary within Customer’s building, in particular the connection between the Local Access entrance point and Customer’s connection point, are not included and are Customer’s responsibility and must be completed prior to the date that the Service is scheduled to be ready for use. Unless otherwise indicated on the Service Order, Orixcom does not proactively monitor or manage Local Access.

Nothing herein shall prevent the Purchaser from arranging for its own Local Access at its sole cost and expense.
(ii) If the Purchaser requests Local Access to be provided by the Grantor, the Grantor shall be responsible for the provisioning and the initial testing of any such Local Access, and any provisioning and the initial testing shall be reasonably coordinated with the applicable Requested Start Date.
(iii) The Grantor agrees that nay and all charges associated with Local Access shall not exceed the sum of the costs that the Purchaser would otherwise pay the same Third-Party Service Provider for the relevant Local Access.
