Common use of Leave Termination Clause in Contracts

Leave Termination. At the termination of a sick leave of absence, the employee will be returned to work, and if possible, at the same or similar job held immediately prior to the leave. If such job is not avail- able, the employee will be offered such job as may be available for which he is duly qualified. The parties agree that there may not be an available position for that employee, such as, but not limited to, due to another labor contract, lack of qualifications, etc. In the event no job is avail- able, said leave will be extended until the Employer has a position to offer for which the employee is qualified. Seniority shall be part of the determination of job availability.
