Common use of Leave Replacement Clause in Contracts

Leave Replacement. A. A leave replacement employee is one who is hired to replace a regular employee who is on an approved leave of absence. The leave replacement employee shall receive the same benefits as a regular employee. B. A leave replacement employee shall be placed into the substitute pool when the assignment ends, and shall be eligible to apply for vacant positions. C. The provisional period required in Article VII, Section 6 will only be served once by leave replacement employees. D. If the regular employee does not return from leave, the position becomes vacant at the end of the scheduled leave and is subject to Article XI, Section 1.A. E. If a regular employee takes a leave replacement position, his/her position shall be filled with a leave replacement employee. At the end of the leave the regular employee shall return to his/her original position and the leave replacement employee shall be placed in the substitute pool and shall be eligible to apply for vacant positions.
