Common use of Kalkines Rights Clause in Contracts

Kalkines Rights. In an interview involving possible criminal matters, where prosecution has been declined by appropriate authority, an employee will be required to answer questions only after the Agency representative has provided the employee with the appropriate assurances. Prior to requiring an employee to answer under such circumstances, the Agency representative shall inform the employee that his/her statements concerning the allegations during the interview cannot and will not be used against the employee in a subsequent criminal proceeding, except for possible perjury charges for any false answers given during the interview. This notice shall be on a form (see Appendix A-6) which shall be signed and dated by the employee at the outset of the interview.
