Common use of Investment Authority Clause in Contracts

Investment Authority. (a) The Trustee shall not be liable in discharging its duties hereunder, including without limitation its duty to invest and reinvest the Fund, if it acts for the exclusive benefit of the Participants and their Beneficiaries, in good faith and as a prudent person would act in accomplishing a similar task and in accordance with the terms of this Trust Agreement and any applicable federal or state laws, rules or regulations.

Investment Authority. (a) The Consistent with the provisions of Section 10(a) below, the Trustee shall not be liable in discharging its duties hereunder, including including, without limitation limitation, its duty to invest and reinvest the Fund, if it acts for the exclusive benefit of the Participants and their Beneficiaries, in good faith and as a prudent person would act in accomplishing a similar task and in accordance with the terms of this Trust Agreement and any applicable federal or state laws, rules or regulations.

(a) The Trustee shall not be liable in discharging its duties hereunder, including without limitation its duty to invest and reinvest the Fund, if it acts for the exclusive benefit of the Participants and their Beneficiaries, in good faith with the care, skill, prudence and as diligence under the circumstances then prevailing that a prudent person acting in a like capacity and familiar with such matters would act use in accomplishing the conduct of an enterprise of a similar task like character and with like aims and in accordance with the terms of this Trust Agreement and any applicable federal or state laws, rules or regulations.

Investment Authority. (a) The Trustee shall not be liable in discharging its duties hereunder, including without limitation its duty to invest and reinvest the Fund, if it acts for the exclusive benefit of the Participants and their Beneficiaries, in good faith and as a prudent person familiar with such matters, would act in accomplishing a similar task and in accordance with the terms of this Trust Agreement and any applicable federal or state laws, rules or regulations, and in accordance with its fiduciary duties as Trustee.

Investment Authority. (a) The Trustee shall not be liable in discharging its duties hereunder, including without limitation its duty to invest and reinvest the Fund, if it acts for the exclusive benefit of the Participants and their Beneficiaries, in good faith and as a prudent person familiar with such matters would act in accomplishing a similar task and in accordance with the terms of this Trust Agreement (including without limitation Section 10 hereof) and any applicable federal or state laws, rules or regulations.

Investment Authority. (a) 7.l The Trustee shall not be liable in discharging its duties hereunder, including without limitation its duty to invest and reinvest the Fundassets of the Trust, if it acts for the exclusive benefit of the Participants and their Beneficiaries, in good faith and as a prudent person familiar with such matters would act in accomplishing a similar task and in accordance with the terms of this Trust Agreement and any applicable federal or state laws, rules or regulations.
