The Advisor shall place orders or otherwise give instructions with respect to the investment of the assets in the Subaccount only after prior notification to and approval by the Trustee in accordance with the provisions of this Subsection 4(c). Recommendation Procedures. 5.04.4.1 If after the application of Article 5.03.10 (Seniority Appointment Procedures) there are additional unstaffed courses, the Appropriate ▇▇▇▇ shall authorize an internal competition for these courses. (i) Where two (2) or more qualified Employees apply for an additional course, the Employee with the most overall University seniority shall be offered the appointment.
(ii) Where two (2) or more qualified Employees have the same overall University seniority, the initial hire date shall break the tie.
(iii) Where two (2) or more qualified Employees have the same level of overall University seniority and have the same initial hire date, and one (1) of those Employees has self-identified as being a member of a group that is under-represented (Article 5.
02.1) then, all else being equal, the member of the under-represented group shall be offered the appointment. Whether a group is found to be under- represented shall be determined based on the data from the Employment Equity Report (Article 5.02.2). 5.04.4.2 After the application of Article 5.04.4.1, if there is an additional unstaffed course for which an Employee has seniority (Article 5.01.3) and that Employee is scheduled to teach eighteen (18) credit hours during the Teaching Year, and provided there is mutual agreement between the Employer and the Union [Articles 4.02.1 b) and d) (v)], then that course may be offered to that Employee in which case the requirement for an external competition under Article 5.04.4.3 shall be waived.
