Interstate Services. For interstate and international Voice Service, the parties hereby agree that the Agreement, to the extent it is subject to FCC regulation, is an inter-carrier agreement not subject to the tariff filing requirements of Section 203(a) of the Communications Act of 1934, as amended. All terms, conditions, and prices for the Voice Services provided by WilTel under the Agreement, to the extent they are telecommunications services subject to FCC regulation, shall be those terms, conditions, and prices contained in the Agreement and related documents, and not those contained in any WilTel federal tariff.
Interstate Services. Customer acknowledges that Provider has no ability to determine whether the communications traffic carried via the Service is jurisdictionally interstate or intrastate. Unless otherwise stated in the applicable Service Order, Customer acknowledges and agrees that the communications traffic to be carried via the Provider Network shall be jurisdictionally interstate, pursuant to the Federal Communications Commission’s mixed-use “10% Rule” (47 CFR 36.154, 4 FCC Rcd. 1352).

Subscribing Entity acknowledges that Service Provider has no ability to determine whether the communications traffic carried via the Service is jurisdictionally interstate or intrastate.
