Applicability of Tariffs. Except as provided herein, Carrier remains subject to the terms and conditions provided in those certain “Port of Houston Authority Tariff No. 14 Additional Rates, Rules and Regulations Governing the Barbours Cut Container Terminal” (“Tariff No. 14”), “Port of Houston Authority Tariff No. 15 Additional Rates, Rules and Regulations Governing the Bayport Container Terminal” (“Tariff No. 15”), and “Port of Houston Authority Tariff No. 8 Rates, Rules and Regulations Governing the Houston Ship Channel and the Public Owned Wharves,” as applicable, currently issued January 1, 2015, and their successive tariffs (collectively, the “Tariffs”); provided, however, that in the case of any conflict between the provisions of this Agreement and the Tariffs, this Agreement shall take precedence.
Applicability of Tariffs. During the term of this Agreement, as it may be amended from time to time, AEP agrees to provide Interconnection and Local Delivery Services for the Customer, and the Customer agrees to pay for such services the charges identified in Attachment 1 hereto and such other charges as shall be applicable hereunder, in accordance with this Agreement and the applicable provisions of the Open Access Transmission Tariff of the AEP System (“AEP Tariff”) and as to certain provisions referenced herein, the Open Access Transmission Tariff of the SPP RTO (“SPP Tariff”), as each tariff shall at any time during the term of this Agreement be on-file and accepted by the Federal Energy Regulatory Commission (“Commission”), including any applicable Schedules and Attachments appended to such tariffs. Interconnection and Local Delivery Services means interconnection of the Parties’ transmission and/or distribution facilities and wholesale distribution service over AEP facilities that are subject to the jurisdiction of the Commission but not expressly provided by the SPP RTO under the SPP Tariff. AEP shall not provide any services or make any charges hereunder that are provided or charged by the SPP RTO under the SPP Tariff or that would be provided or charged under the AEP Tariff. Capitalized terms that are not defined within this Agreement shall have the meanings as specified in the SPP Tariff or the AEP Tariff as applicable.

Applicability of Tariffs. This Agreement orders Services at rates provided herein and subject to the terms and conditions set forth in Call One's then-applicable state tariff, which tariff is incorporated by reference. State tariffs are available through the regulatory page of the Call One web site currently at xxx.xxxxxxx.xxx. Customer acknowledges all services purchased pursuant to this agreement are for business purposes.
Applicability of Tariffs. During the term of this Agreement, as it may be amended from time to time, FirstEnergy agrees to provide Services for Tri-County, and Tri-County agrees to pay for such Services as provided in this Agreement. The term “Services” means those services described herein which are subject to the jurisdiction of the FERC but not provided by PJM under the PJM Tariff. In addition, the applicable provisions of the PJM Tariff, as such tariff shall at any time during the term of this Agreement be on file and accepted by FERC, including any applicable Schedules and Attachments appended to such Tariff shall apply. FirstEnergy shall not provide any Services or levy any charges hereunder that are provided or charged by PJM under the XXX Xxxxxx. FirstEnergy and Tri-County’s rights and obligations with respect to Services are limited to the terms of this Agreement.
