  • Grounds for refusal Under Clause 1 of Article 1377 of the Civil Code of the Russian Federation the application for grant of a patent for an industrial design shall be related to one industrial design or to a group of industrial designs associated with each other so closely as to form a single creative concept (the requirement of unity of the industrial design). This requirement is met where there is: one independent and distinct industrial design; or one industrial design and its variants differing from that industrial design by visually non-essential features and/or by color combination; or a group of industrial designs belonging to the same set of articles, as well as one or more industrial designs for separate articles belonging to the same set of articles. It is required that all industrial designs of the group shall belong to the same class of International Classification for Industrial Designs (Locarno classification). Under Clause 1 of Article 1352 of the Civil Code of the Russian Federation the essential features of an industrial design shall include features determining the aesthetic characteristics of the external appearance of the article, in particular, the shape, configuration, ornamentation, combination of colors, lines, contours of the article, texture or material of the article. The essential features of the external appearance are recognized as essential if they determine the aesthetic characteristics of the external appearance of an article, being dominant and determine the overall visual impression. The non-essential features of the external appearance include such slightly distinguishable and inexpressive features of the external appearance of an article, the exclusion of which from the set of the features of the external appearance does not lead to a change the overall visual impression (clause 72 of the Rules for the drafting, filing and examination of the documents, that are the basis for legally significant actions on the state registration of an industrial design). The claimed group of industrial designs includes: the industrial design 1: fig. 1.1-1.7; the industrial design 2: fig. 2.1-2.7. The claimed group of industrial designs does not meet the requirement of unity of the industrial design. Only one of the claimed industrial designs of this application can be considered.

  • Shipping must be Freight On Board Destination to the delivery location designated on the Customer purchase order The Contractor will retain title and control of all goods until delivery is completed and the Customer has accepted the delivery. All risk of transportation and all related charges are the responsibility of the Contractor. The Customer will notify the Contractor and H-GAC promptly of any damaged goods and will assist the Contractor in arranging for inspection. The Contractor must file all claims for visible or concealed damage. Unless otherwise stated in the Agreement, deliveries must consist only of new and unused merchandise.

  • First Offense The participant will not participate in the next contests/events, beginning with the first contest/event in which he/she would participate after determination that an infraction has occurred, equal to 20% of the number of regular scheduled contests/events. The participant will also be referred to the Centerville High School Crisis Intervention Counselor or their Middle School Guidance Counselor. The participant will be permitted to practice during the time period of his/her co- curricular suspension. The participant’s reinstatement and eligibility will be determined by the Athletic Director. OR: The number of contests/events to be suspended from can be reduced to 10% if the participant agrees to complete 20 hours of approved community service within 45 days of determination that an infraction has occurred. Failure to comply with this will add an additional 20 % suspension at the end of 45 days plus all awards will be revoked. Proof of an approved community service plan being in place must be presented to the Athletic Director prior to being reinstated to participate after the 10% suspension has been served. All other consequences relating to intervention, practice, reinstatement, and eligibility remain the same. Second Offense (and subsequent offenses): The participant will not participate in any Centerville High School co-curricular activity for one calendar year from the date of determination that a second infraction has occurred. The participant will also be referred to the Centerville High School Crisis Intervention Counselor. The participant will not be permitted to practice or take part in any co-curricular events during this time period. The participant’s reinstatement and eligibility will be determined by the Athletic Director. OR: The suspension can be reduced to 6 months if the participant agrees to complete 40 hours of approved community service within 90 days of determination that an infraction has occurred. Failure to comply with this will result in a year suspension beginning at the end of 90 days. All other consequences relating to intervention, reinstatement, and eligibility remain the same. CITIZENSHIP Any possible infraction of the citizenship clause will be reviewed by the athletic director and coach. A decision will then be made which could result in the assignment of community hours and/or suspension from contests. Citizenship infractions will not be considered “offenses” (1st, 2nd, . . .).

  • Sole Source as Grounds for Rejection of a Change Order If a Change Order is submitted to Contractor for the purposes of adding a Bulletin to this Contract and said Bulletin designates a Sole Source from which Contractor is required to procure goods or services necessary to perform the Work, which Sole Source has not been designated previously, Contractor shall be entitled to reject the proposed Change Order if the designated Sole Source refuses to provide to Contractor the warranties, bonds, terms or schedule required under the Contract Documents, including any warranty or terms or schedule required by Bulletins referenced in the proposed Change Order. In such event, Contractor shall give written notice to the Owner rejecting the proposed Change Order and, if possible, shall accompany said written notice with a proposal from Contractor for changes or modifications to the Bulletin so as to eliminate the Sole Source designation but to achieve goods or services equal in quality or function. The Owner may then require the Design Professional to revise the subject Bulletin so as to eliminate the designation of the Sole Source by incorporation of Contractor's proposal or otherwise. Upon revision of the Bulletin by the Design Professional and approval thereof by the Owner, the Owner shall again submit to the Contractor a proposed Change Order for the purpose of adding the revised Bulletin to this Contract. If the Owner decides to retain the Sole Source in the Change Order and Contractor cannot acquire the full contractually required warranties from the Sole Source, Contractor shall be held only to the warranty terms and schedule obtainable from the Sole Source.

  • Engagement of the TAM Representative Outside of Red Hat Standard Business Hours If you have purchased Premium Red Hat Software Subscriptions, you will receive 24x7 Support for Severity 1 and 2 issues through Red Hat’s 24x7 Production Support teams and not necessarily from your assigned TAM representative. Red Hat’s 24x7 Production Support team will be responsible for addressing issues, but will consult with your TAM representative, as your TAM representative is available, for advice and to gain a better understanding of your infrastructure, environment and specific needs. If you have purchased multiple TAM Service Subscriptions in each of Red Hat’s primary Support Regions, you will receive the benefit of extended TAM Service coverage hours, but you should follow the same process and contact the Red Hat 24x7 support numbers at xxxxx://xxxxxx.xxxxxx.xxx/support/contact/technicalSupport.html.

  • Outpatient emergency and urgicenter services within the service area The emergency room copay applies to all outpatient emergency visits that do not result in hospital admission within twenty-four (24) hours. The urgicenter copay is the same as the primary care clinic office visit copay.

  • Emergency and urgently needed care outside the service area Professional services of a physician, emergency room treatment, and inpatient hospital services are covered at eighty percent (80%) of the first two thousand dollars ($2,000) of the charges incurred per insurance year, and one-hundred percent (100%) thereafter. The maximum eligible out-of-pocket expense per individual per year for this benefit is four hundred dollars ($400). This benefit is not available when the member’s condition permits him or her to receive care within the network of the plan in which the individual is enrolled.

  • Other Fires on Sale Area Forest Service shall pay Purchaser, at fire fighting rates common in the area or at prior agreed rates, for equipment or personnel furnished by Purchaser pursuant to B7.3, or otherwise at the request of Forest Service, on any fire on Sale Area other than an Operations Fire or a Negligent Fire. B7.5 State Law. Purchaser shall not be relieved by the terms of this contract of any liability to the United States for fire suppression costs recoverable in an action based on State law, except for such costs resulting from Operations Fires. Amounts due Purchaser for fire fighting expenditures in accordance with B7.41 shall not be with- held pending settlement of any such claim or action based on State law.
