Common use of Innovation Charge Clause in Contracts

Innovation Charge. If the RCG endorses an ‘Innovation Payment’ (as that term is defined in the Access Undertaking) which relates in whole or in part to the Access Holder or a Pricing Zone in which the Access Holder’s Services operates, then the amount and frequency of the Innovation Charge payable by the Access Holder will be determined by reference to the Innovation Payment and methodology for calculating the Innovation Charge set out in the Innovation Proposal (as that term is defined in the Access Undertaking) endorsed by the RCG in accordance with the Access Undertaking or as otherwise agreed between ARTC and the Access Holder.
