In no event shall this Section be construed as a waiver by Owner the State of Oregon of any form of defense or immunity, whether based on sovereign immunity, governmental immunity, immunity based on the Eleventh Amendment to the United States Constitution or otherwise. Any claim, action, suit or proceeding (collectively “collectively, "Claim”") between Owner Washington County and Architect Contractor that arises from or relates to this Agreement Contract shall be brought and conducted solely and exclusively within the Circuit Court of Xxxxxx County for the State of OregonWashington County; provided, however, if a Claim must be brought in a federal forum, then it shall be brought and conducted solely and exclusively within the United States District Court for the District of Oregon. In no event shall this Section section be construed as a waiver by Owner Washington County of any form of defense or immunity, whether based on it is sovereign immunity, governmental immunity, immunity based on the Eleventh Amendment to the Constitution of the United States Constitution or otherwise, from any Claim or from the jurisdiction of any court.
