Common use of Gardening Clause in Contracts

Gardening. The Landlord Resident (check one) will pay for, water and maintain the garden, landscaping, trees and shrubs. Landlord will maintain the sprinkler system unless damage is caused by Resident. Resident is responsible for notifying Landlord of any malfunction of the system within two days of system malfunctioning. Landlord and Resident agree that State or local water use restrictions shall supersede any obligation of the Landlord or Resident to water or maintain any garden, landscaping, trees or shrubs. Resident's failure to maintain any item for which Resident is responsible shall give Landlord the right to hire someone to perform such maintenance and charge Resident to cover the cost of such maintenance.
