Common use of Fringe Benefit Plans Clause in Contracts

Fringe Benefit Plans. Except as specified otherwise in this -------------------- Agreement, effective as of the Distribution Date (or such other date(s) as Catalytica and CESI may mutually agree in writing), CESI shall adopt the CESI Fringe Benefit Plans. Except as otherwise specified in this Agreement, to the extent administratively and financially practicable, each of the foregoing CESI Fringe Benefit Plans as in effect as of the Distribution Date (or such other date(s) as Catalytica and CESI may mutually agree in writing), shall be comparable in the aggregate in all Material Features to the corresponding Catalytica Plan as in effect as of such agreed upon date.
