First Appeal Procedure. Step 2 5.4.1 If the alleged grievance has not been resolved in Step 1, the grievant, within ten (10) days after completion of Step 1, may submit the written grievance (Grievance Form C) to the Superintendent for resolution. 5.4.2 The Superintendent or designee shall hold a meeting (within five [5] days after the date of receipt of Form C) with the grievant who may have conferees present to help in resolving the grievance. The Superintendent or designee may also have conferees present. 5.4.3 A response in writing (Grievance Form D) shall be transmitted to the grievant ten (10) days after the initial meeting. The failure of the Superintendent to respond shall be deemed a negative decision. If the Superintendent or designee fails to respond, or if the grievant deems the response unsatisfactory, the Grievance may be taken to Step 3. Failure by a grievant to appeal a decision within the specific time limits shall be deemed an acceptance of the decision. 5.4.4 The Superintendent shall transmit a copy of the grievance and the response to CSEA. CSEA may file a response within ten (10) days after mailing of the documents. The Superintendent shall issue his/her final decision within five (5) days after the receipt of the response or the running of ten (10) days, whichever is first.
