A Firm Response clause establishes that an offer or proposal made by one party is binding and cannot be revoked for a specified period. In practice, this means that once a party issues a firm response, they are legally obligated to honor the terms of their offer, even if they receive a better offer or change their mind during the stated timeframe. Firm Response. The Department should make an award within sixty (60) days after the date of the opening, during which period responses shall remain firm and shall not be withdrawn. Any response that expresses a shorter duration should, in the Department's sole discretion, be accepted or rejected.
