The Final Evaluation Phase clause defines the process and criteria for the concluding assessment of a project, product, or service before final acceptance. Typically, this phase involves a comprehensive review or testing to ensure all contractual requirements and performance standards have been met. For example, it may include inspections, user acceptance testing, or a formal sign-off procedure. The core function of this clause is to establish a clear, objective process for determining whether the deliverables are satisfactory, thereby reducing disputes and ensuring both parties agree on completion.
Final Evaluation Phase. 7.6.1 The evaluator shall state his/her opinions as to whether or not the performance goal agreed upon in the process of the evaluation has been met. The evaluator shall write the final evaluation summary and both parties will sign it. The final evaluation will be given to the Unit Member no later than 30 student days prior to the last student day.
Final Evaluation Phase. 6.3.3.1 Unit members shall receive their final evaluation no later than thirty (30) calendar days prior to the close of the school year in which they are evaluated.
6.3.3.2 A meeting between the evaluator and the unit member shall be held regarding the final evaluation no later than the last school day on the Unit Member Service Calendar. The unit member may be accompanied by a Union representative at conferences held subsequent to the final evaluation conference. All evaluations shall be submitted to the District personnel file at the close of the school year, and all meetings and conferences shall be held prior to that time.
6.3.3.3 A unit member who receives an unsatisfactory evaluation in the areas of teaching methods/instruction or content knowledge shall be placed in the N-MUSD Peer Assistance and Review program, as prescribed in Education Code Section 44664 (b) and Article 7 of this contract.
6.3.3.4 The unit member shall have the opportunity to initiate a written response to the final evaluation. Such response shall become a permanent attachment to the evaluation and shall be placed in the unit member's District personnel file.

7.6.2 Signature by the unit member shall not indicate acceptance of the conclusions of the evaluator, but shall only indicate the unit member has received a copy of the evaluation form. Comments on or disagreements with the evaluation may be submitted by the unit member as the unit member feels necessary. Such comments will be attached to the evaluation and will become a permanent part of the unit member's personnel file.
7.6.3 The evaluation of permanent teachers shall occur no less than once in every two years Evaluations of probationary and temporary teachers shall occur at least once each year. At the discretion of the site administrator, evaluation of unit members may be more often.

There shall be a maximum of five formal observations during the re-evaluation in the subsequent year(s).
d. Notification of such re-evaluation will be made in writing no later than thirty (30) days prior to the last school day scheduled. Reasons for such re-evaluation caused by the evaluatee may be, but are not limited to, any of the following:
(i) Failure to meet deadlines with the exception of a an emergency
(ii) Failure to follow evaluation guidelines
(iii) In order to receive an overall unsatisfactory evaluation, a teacher must receive a minimum of three (3) unsatisfactory rating in the six (6) California Standards for the Teaching Profession.
e. The written notification will include an Improvement Plan with a timeline which addresses the area(s) of unsatisfactory performance. The area(s) will be central to the re-evaluation.
f. Any evaluation containing an unsatisfactory rating shall include the requirement that the certificated employee participate in the PAR program, if funded. A PAR assistance plan will be designed by the Joint Committee with input from the certificated employee to improve appropriate areas of the employee's performance and further pupil achievement and the instructional objectives of the District.
g. If PAR is not funded, a written improvement plan with a timeline shall be developed, including identification of support tools. The evaluator and the evaluatee shall mutually agree upon the plan. However, absent agreement, final approval of a reasonable plan shall be the responsibility of the evaluator.
