Common use of Extension of Time as a Result of Force Majeure Clause in Contracts

Extension of Time as a Result of Force Majeure. Where a PARTY is prevented from exercising any rights or performing any obligations under this Agreement due to Force Majeure, the time for the performance of the obligations affected thereby and for performance of any obligation or the exercise of any right dependent thereon may be extended by such additional period as may be agreed between the PARTIES or failing agreement, by resolution in accordance with Article 12.
