Common use of Existing Vacancy Clause in Contracts

Existing Vacancy. If, upon the effective date of the termination or discharge due to a R.I.F., there is an existing vacancy in another program for which the affected person is licensed and qualified, he/she shall be transferred or reassigned to that vacant position. There shall be no obligation to create a vacancy to accommodate such person.
