Executive Level Performance Review. Face-to-face negotiations will be conducted by a senior executive officer of each Party (or such other executive as a Party may designate). If these representatives are unable to resolve the Dispute within five (5) business days after the Parties have commenced negotiations or ten (10) business days have passed since the initial request for a meeting at this level, then the Parties may jointly engage the services of a third-party mediator.
Executive Level Performance Review. For Problems that are not resolved as described in Section 17.1.2, negotiations shall be conducted by the Chief Information Officer or higher-level officer of Symetra and the Western Region Vice President or higher-level officer of ACS. If such representatives are unable to resolve the Problem within five (5) Business Days after the Parties have commenced negotiations, or fifteen (15) calendar days have passed since the initial request for negotiations at this level, then the Parties shall be entitled to discontinue negotiations, to seek to resolve the Problem through mediation as hereinafter provided or, if the Parties do not agree to submit the Problem to mediation, to seek any and all rights and remedies that may be available to them as provided in this Agreement.

If these representatives are unable to resolve the dispute within ten (10) calendar days after the representatives have commenced negotiations, or twenty (20) calendar days have passed since the initial request for negotiations at this level, then the parties may agree in writing to submit the dispute to mediation.

If the Project Manager level performance review does not result in successful resolution of the dispute, the appropriate executive officers of Allegiance and Lucent shall meet in an effort to resolve the dispute. Written minutes of such meetings shall be kept by the parties. If these representatives are unable to resolve the dispute within five (5) calendar days after the representatives have commenced negotiations, or ten (10) calendar days have passed since the initial request for negotiations at this level, then the dispute may be submitted to non-binding mediation in accordance with SECTION 14.3.

For disputes that are not resolved at the level specified in Section 14.1, the Executive Sponsors may, but shall not be obligated to, meet and attempt to resolve the dispute. If such representatives are unable to resolve the dispute within five (5) business days after the parties have commenced negotiations, or ten (10) days have passed since the initial request for negotiations at this level, or if the parties do not agree to invoke this level if dispute resolution, then the parties may seek to resolve the dispute through mediation as hereinafter provided or, if the parties do not agree to submit the dispute to mediation, to seek any and all rights and remedies that may be available to them as provided in the Agreement.

If such representatives are unable to resolve the dispute within five (5) business days after the Parties have commenced negotiations, or fifteen (15) business days have passed since the initial request for negotiations at this level, then the Parties shall be entitled to discontinue negotiations, and to seek any and all rights and remedies that may be available to them under this Agreement. The periods of calendar or business days referred to in this Section 14 may be extended by mutual agreement of the Parties. 15.
Executive Level Performance Review. Upon request, appropriate executive officers of MetroPCS and Supplier shall meet in an effort to resolve any dispute. Written minutes of such meetings shall be kept by the parties. If these representatives are unable to resolve the dispute within *** days after the representatives have commenced negotiations, or *** have passed since the initial request for negotiations at this level, then the dispute may be submitted to non-binding mediation in accordance with Section 8.2.
Executive Level Performance Review. Face-to-face negotiations regarding any dispute not resolved in accordance with Section 13.1 shall be conducted by senior executive officers of Sears and Licensee. If these representatives are unable to resolve the dispute within ten (10) calendar days after the representatives have commenced negotiations, or twenty (20) calendar days have passed since the initial request for negotiations at this level, then the parties may agree in writing to submit the dispute to mediation.
