Exclusive Representation and Authority. The Parties recognize the importance of retaining Core Employees to the continuity of operations in DBE firms. Accordingly, there will be no limit on the use of Core Employees for certified DBEs. Additionally, there shall be no requirement for certified DBE Employers to pay union health benefits where such firms otherwise provide their employees with comparable health benefits or add the fringe amount of these health benefits to employee wages. In such circumstances, a firm will be required to provide quarterly documentation of the provision of such comparable health benefits or paid fringe amounts to the Owner. In addition, each employee for whom such waiver is requested must also file a written request for a waiver of contributions with the Owner. There shall be no requirement for non-signatory DBEs to contribute to other union trust funds.
