Excess Employee. (i) The procedure for handling excess employees set out below applies to all employees except: an ongoing employee who is on probation; a non-ongoing employee. (ii) When the President is aware that an employee is likely to become excess, the President will advise the employee of the situation at the earliest practicable time. An employee is an excess employee if: the Commission has a greater number of employees than is necessary for the effective performance of a particular role or function within the Commission; the services of the employee cannot be effectively used because of technological or other changes in the work methods of the Commission or changes in the nature, extent or organisation of the functions of the Commission; or where the duties usually performed by the employee are to be performed at a different locality, the employee is not willing to perform duties at the locality and the President has determined that the provisions of this clause will apply to that employee.
