Excel’s Provision of Collocation. Upon request by Verizon, Excel shall provide to Verizon collocation of facilities and equipment for the purpose of facilitating Verizon’s interconnection with facilities or services of Excel. Excel shall provide collocation on a non-discriminatory basis in accordance with Excel’s applicable Tariffs, or in the absence of applicable Excel Tariffs, in accordance with terms, conditions and prices to be negotiated by the Parties. 1. 911/E-911 Arrangements 1.1 Excel may, at its option, interconnect to the Verizon 911/E-911 Selective Router or 911 Tandem Offices, as appropriate, that serve the areas in which Excel provides Telephone Exchange Services, for the provision of 911/E-911 services and for access to all subtending Public Safety Answering Points (PSAP). In such situations, Verizon will provide Excel with the appropriate CLLI codes and specifications of the Tandem Office serving area. In areas where E-911 is not available, Excel and Verizon will negotiate arrangements to connect Excel to the 911 service in accordance with applicable state law. 1.2 Path and route diverse Interconnections for 911/E-911 shall be made at the Excel-IP, the Verizon-IP, or other points as necessary and mutually agreed, and as required by law or regulation. 1.3 Within thirty (30) days of its receipt of a complete and accurate request from Excel, to include all required information and applicable forms, and to the extent authorized by the relevant federal, state, and local authorities, Verizon will provide Excel, where Verizon offers 911 service, with the following at a reasonable fee, if applicable: 1.3.1 a file via electronic medium containing the Master Street Address Guide (“MSAG”) for each county within the LATA(s) where Excel is providing, or represents to Verizon that it intends to provide within sixty (60) days of Excel’s request, local exchange service, which MSAG shall be updated as the need arises and a complete copy of which shall be made available on an annual basis; 1.3.2 a list of the address and CLLI code of each 911/E-911 selective router or 911 Tandem office(s) in the area in which Excel plans to offer Telephone Exchange Service; 1.3.3 a list of geographical areas, e.g., LATAs, counties or municipalities, with the associated 911 tandems, as applicable. 1.3.4 a list of Verizon personnel who currently have responsibility for 911/E-911 requirements, including a list of escalation contacts should the primary contacts be unavailable. 1.3.5 any special 911 trunking requ...

  • Construction of Provisions Although certain provisions of this Agreement contain express language which precludes the Servicer's recovery of, or reimbursement for, expenses incurred hereunder, no inference to the contrary shall be drawn from absence of such, or similar, language in any other provision hereof regarding expenses.

  • Location of Collateral All tangible items of Collateral, other than Inventory in transit, shall at all times be kept by Borrowers at the business locations set forth in Schedule 8.6.1, except that Borrowers may (a) make sales or other dispositions of Collateral in accordance with Section 10.2.6; and (b) move Collateral to another location in the United States, upon 30 Business Days prior written notice to Agent.

  • Incorporation of Provisions The contractor will include the provisions of paragraphs one through six in every subcontract, including procurements of materials and leases of equipment, unless exempt by the Acts, the Regulations and directives issued pursuant thereto. The contractor will take action with respect to any subcontract or procurement as the sponsor or the Federal Aviation Administration may direct as a means of enforcing such provisions including sanctions for noncompliance. Provided, that if the contractor becomes involved in, or is threatened with litigation by a subcontractor, or supplier because of such direction, the contractor may request the sponsor to enter into any litigation to protect the interests of the sponsor. In addition, the contractor may request the United States to enter into the litigation to protect the interests of the United States.

  • Application of other Provisions If the provisions of law of either Contracting Party or obligations under international law existing at present or established hereafter between the Contracting Parties in addition to the present Agreement contain a regulation, whether general or specific, entitling investments by nationals of the other Contracting Party to a treatment more favourable than is provided for by the present Agreement, such regulation shall to the extent that it is more favourable prevail over the present Agreement.
