Error in Use of Terminal. (1) Once the Bank has made a refund from your Deposit Account after recognizing from its electromagnetic records the Card used for operating the Terminal as duly issued by the Bank and identifying the PIN which you have registered, the Bank shall bear no responsibility for damages arising from and attributable to forgery, falsification, fraudulent use or any other incidents with respect to your Card or PIN. Provided however, this shall not apply if the Bank is able to confirm that such refund was made using a forged Card and there exist no reasons attributable to the depositor with respect to control of the Card and the PIN.
