Common use of ENTERPRISE FACILITATIVE PROVISION Clause in Contracts

ENTERPRISE FACILITATIVE PROVISION. The enterprise and its’ employees may negotiate a special clause that provides flexibility and / or efficiencies for the enterprise. This should be achieved through a consultative process with employees and, where requested, their representatives. Prior to this Agreement being submitted to the Australian Industrial Relations Commission for certification, the parties will identify, and agree upon, no more than three workplace efficiency and flexibility provisions to apply in respect of the enterprise. Provided these flexibilities do not lead to a reduction in conditions of employment. Any agreement reached under this provision shall be in writing.
