For purposes of this Agreement, the term “Company Competitor” means any engineering, program management, or construction company engaged in any activities or businesses similar in material respects to the Company’s business and/or listed among the top 25 companies on any ENR (Engineering News Record) list of top industry leaders (for a year in question), where the Company is listed in the top 25 companies on the list.
