Common use of Employment by the Company Clause in Contracts

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of President and Chief Executive Officer of the Company, subject to the control and direction of the Company's Board of Directors (the "Board of Directors").

The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of President Chief Financial Officer and Chief Executive Officer of the CompanySenior Vice President, subject to the control and direction of the Company's Board of Directors ’s Chief Executive Officer (the "Board of Directors"“CEO”).

The Company hereby agrees to employ the Executive for the Term (as herein defined), and the Executive hereby agrees to render exclusive and fullpart-time services in the capacity of President and Chief the Executive Officer Chairman of the CompanyCompany (the “Executive Chairman”), subject to the control and direction of the Company's ’s Board of Directors (the "Board of Directors"“Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Executive Financial Officer of the CompanyCompany during the Executive Period (as herein defined), subject to the control and direction of the Company's ’s Chief Executive Officer (the “CEO”) and its Board of Directors (the "Board “Board”), and to render services on a part-time basis as requested by the Company in the capacity of Directors"Director (Staff) during the Transition Period (as herein defined).

The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Executive Officer - Store Operations of the Company, subject to the control and direction of the Company's ’s Chief Executive Officer (“CEO”) and its Board of Directors (the "Board of Directors"“Board”).

The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Executive Administrative Officer of the Company, subject to the control and direction of the Company's ’s Chief Executive Officer (“CEO”) and its Board of Directors (the "Board of Directors"“Board”).

The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Executive Vice President and Chief Executive Officer — Store Operations of the Company, subject to the control and direction of the Company's ’s Chief Executive Officer (“CEO”) and its Board of Directors (the "Board of Directors"“Board”).

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defined), to render exclusive and full-time services in the capacity of Divisional Vice President and Chief Executive Officer — Tire Stores of the Company, subject to the control and direction of the Company's Board of Directors (the "’s President and Board of Directors").

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defineddefined in Section 2), to render exclusive and full-time services in the capacity of President and Chief Executive Officer of the Company, subject to the control and direction of Company as its Executive Vice President to perform such duties commensurate with such office as the Company's Board of Directors of the Company (the "Board of Directors")) and/or the Co-Chief Executive Officers of the Company shall reasonably direct. The Executive shall report directly to the Co-Chief Executive Officers of the Company. The Executive shall devote his full business time to the business of the Company during the term.

During the Term (as herein hereinafter defined), the Executive shall report to render exclusive and full-time services in the capacity of President and Company’s Chief Executive Officer of the Company, subject to the control and direction of the Company's Board of Directors (the "Board of Directors")Officer.

The Company hereby agrees to employ the Executive for the Term (as herein defineddefined in Section 2), to render exclusive and full-time services in to the capacity of Company as its President and Co-Chief Executive Officer of and to perform such duties commensurate with such office as the Company, subject to the control and direction of the Company's Board of Directors of the Company (the "Board of Directors")) shall reasonably direct.

Employment by the Company. The Company hereby agrees to employ the Executive for the Term (as herein defineddefined in Section 2 below), to render exclusive and full-time services in the capacity of President and Chief Executive Officer ("CEO") of the Company, subject to the control and direction of the Company's Board of Directors (the "Board of DirectorsBoard").

The Executive shall report directly to the Co-Chief Executive Officers of the Company. The Executive shall devote his full business time to the business of the Company during the term.
