Common use of Employment by the Company Clause in Contracts

Employment by the Company. Executive agrees to be employed by the Company during the Term upon the terms and subject to the conditions set forth in this Agreement. Executive shall serve as an executive of the Company and shall have such duties as may be prescribed by the Company and shall serve in such other and/or additional position(s) as the Company may determine from time to time.

Executive shall serve as an executive President and Chief Executive Officer of the Company, reporting to the Board of Directors of the Company (the "Board") and shall have such duties as may be prescribed by the Company and shall serve in such other and/or additional position(s) as the Company may determine Board from time to timetime and which are commonly performed by CEO/Presidents of similar sized companies conducting similar business, such as, but not limited to, corporate planning and oversight of the financial, marketing, research and other vital functions of the organization.
