Common use of Election Respecting Compensation Clause in Contracts

Election Respecting Compensation. (a) Subject to the provisions of Section 7.8 respecting the accumulation of overtime, every employee who is entitled to compensation pursuant to Sections 7.3 to 7.6 and paragraphs 8.2(b) and 8.2(c) shall elect either to be paid or to receive time off in lieu thereof, provided that in respect of working overtime or on a public holiday, the election shall be made at the time such compensation is earned, and in respect of compensation pursuant to paragraph 8.2(c), the election shall be made as soon as reasonably possible.
