Educator Evaluation. A. Educators shall be evaluated by personnel eligible for certification by the State Department of Education no less than the minimum required by the Code of Maryland Regulations (COMAR) section on the Evaluation of Professionally Certified Personnel. 1. All monitoring or observation of the work performance of an educator will be conducted openly and with full knowledge of the educator. 2. Written comments shall be made concerning any observation resulting in the evaluation of the employee's work. 3. A duplicate copy of all written comments as a result of observation will be given to the employee within five (5) duty days. B. 1. A personnel file shall be maintained in the Human Resources Office of the Board of Education. Any employee shall have the right, upon request, to review the contents of the employee's personnel file, and to receive a copy, at the employee's expense, of any document contained herein, excluding letters of recommendation. Any employee shall be entitled to have a representative of the Association accompany the employee during such review. Although the Board agrees to protect the confidentiality of personal references, academic credentials, and other similar documents, it will not establish separate "confidential" files.

Educator Evaluation. The Parties shall comply with the Educator Evaluation requirements as contractually obligated. However, because of the later student start date and new modes of educating, the Parties will negotiate any needed changes to the Units A and B Educator Evaluation System.
Educator Evaluation. Section 1Evaluation Instrument and Structure (a) The Rhode Island Innovation Consortium (RIIC) System for Educator Evaluation is the exclusive evaluation tool for all certified staff for which its design is intended. Implementation of the RIIC Evaluation System will be governed by a separate mutual agreement. (b) Bargaining unit members who are certified in areas that the RIIC System for Educator Evaluation is not designed to assess will be evaluated by a mutually developed or selected instrument.

Educator Evaluation. The Parties agree to establish or continue with the previously established joint management labor committee to negotiate those provisions of the new educator evaluation regulations requiring negotiations for implementation is September 2012. The Parties agree to incorporate any agreements reached as a result of such negotiations into this Agreement.
Educator Evaluation. A. It is the intent that all evaluation of an educator be open and with the full knowledge of the educator. B. The evaluation shall be in accordance with the evaluation policy (GCOA) adopted by the Board. C. An educator shall be given feedback for any class visit or evaluation report as set forth in the Performance Evaluation and Professional Growth (PEPG) process. No such report shall be submitted to the central office, placed in the educator’s file, or otherwise acted upon without a prior conference with the educator, unless the educator waives the right to a conference. No educator shall be required to sign a blank or incomplete evaluation form. D. No educator shall receive adverse comments from an observer in the presence of students. E. The final evaluation of an educator shall be placed in his/her personnel file upon termination. No documents shall be placed in an educator’s file after severance. F. The PEPG Committee will be comprised of administrators, educators, and members of the RSU5 community. The Committee will monitor implementation of the PEPG system and recommend revisions as needed. G. Following observations, the observer can suggest ways of improving; these suggestions shall be placed in the educator’s e-portfolio in a timely fashion, as set forth through the PEPG process. This does not preclude observers from providing additional information consistent with the unified evaluation process. Probationary teachers, as outlined in the PEPG document, will also follow the mini-observation process with suggestions for improvement placed in the educator’s e-portfolio. In some situations, it is understood that additional more formal observations and feedback may be warranted. The parties acknowledge that the form, content, and frequency of educator evaluation, and the identity and qualifications of the evaluators, constitutes educational policy and that any changes by the Board shall be subject to the meet and consult and impacting bargaining obligations described in the Miscellaneous Article of the Agreement.

The requirements and timeline provided for in the Parties’ collective bargaining agreement shall remain unchanged; however, the mechanics of the evaluation may vary based on the District’s method of delivery of instruction to students (i.e. remote instruction, hybrid, or all in-person). If the Educator Evaluation timeline requires modification due to the student year, the Parties will negotiate any changes and may adjust the timeline accordingly. The District-wide Labor Management Committee will convene to determine the timeline and focus indicators for evaluation for the 2020-2021 work year.
