Easement Purposes. The Access Easement shall be used only for the following purposes (“Permitted Purposes”): (i) to transport dirt, sand, caliche, gravel, crushed limestone, lime, asphalt, concrete, ready mix, hot mix asphalt concrete and cement, road base and construction aggregates (collectively, “Aggregate Materials”) by truck (or other standard over-the-road vehicles) from the MMM Property to the ▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇▇ Road or the La Quinta Properties for continuing delivery to construction sites located on the La Quinta Properties for construction of facilities on any such sites; and (ii) as a return route to the MMM Property for trucks and other standard over-the-road vehicles which have transported Aggregate Materials to any such construction sites on any of the La Quinta Properties. (iii) The Easement may not be used for ingress and egress by MMM’s owners, shareholders, employees, or invitees, but may only be used by vehicles actively involved in transporting Aggregate Materials to the La Quinta Properties.
