Common use of Duration of Rights Clause in Contracts

Duration of Rights. The Rights shall expire and shall be worthless on the 1 year anniversary of the Exchange Event. If an Exchange Event does not occur within the time period set forth in the Company’s Amended and Restated Certificate of Incorporation, as the same may be amended from time to time, the Rights shall expire and shall be worthless.
