District Information. The Consultant acknowledges that it shall now, and in the future may, have access to and contact with confidential information relating to ideas, strategies, plans, purposes, and/or agendas that the District may seek to advance. Any reports and information given to or generated by the Consultant hereunder, as well as the terms and conditions of this Agreement, shall also be considered confidential information. Both during the term of this Agreement and thereafter, the Consultant covenants and agrees to hold such information in trust and confidence and to exercise diligence in protecting and safeguarding such information, as well as any other information protected from public disclosure by federal or state law or by the policies or procedures of the District. The Consultant covenants and agrees it will not knowingly use, directly or indirectly, for its own benefit, or for the benefit of another, any of the confidential information, but instead will use such information only for the purposes contemplated hereunder. Further, the Consultant covenants and agrees that it will not disclose any confidential information to any third party except as may be required in the course of performing services for the District hereunder or by law. In no event, shall the Consultant be deemed a spokesperson for the District, nor shall Consultant utilize the District, the District’s logo, and/or District information in any marketing materials without the express written consent of the District.
District Information. The Board agrees to make available to the Association in response to requests for information including but not limited to: annual financial reports and audits, register of personnel, tentative budgetary requirements and allocations, agenda and minutes of all Board meetings, pupil enrollment figures, and names and addresses of all paraeducators.

The District agrees to furnish the Association available information concerning the financial resources of the District, including but not limited to financial reports, tentative budgetary requirements and allocations, agendas and minutes of Board meetings and seniority lists. The District also agrees to provide the Association with information needed by the Association to develop constructive negotiation proposals, provided, however, that the District shall not be required to prepare reports or surveys. The District further agrees to provide the following information to the Association: 1. Names, addresses, assignments and work sites of all MBUs hired by the District within 20 days of the date the individual starts working or the Board approves the contract, whichever is earlier; 2. All vacancy notices will be sent to the Association on the first day of each week; 3. Lists of all completed transfers on the first day of each month; 4. Lists of all reinstatements, replacements, new positions and contract changes by the third Wednesday of each month; 5. Lists of all terminations, resignations, retirements, leaves of absence and any other separations by the third Wednesday of each month; 6. Lists showing MBUs assigned to each building by October 1. 7. Lists of all extra duty assignments, including name, school, assignment and extra duty assignment by November 1 of each year; 8. Lists of substitutes in alphabetical order by October 1 of each year; 9. Seniority lists by date of hire and alphabetical order by October 1 and March 1 of each year; 10. Class size lists per MBU by building by October 15th of each year; 11. Lists of the specific administrators responsible for the distribution, preparing and compiling of the data listed in the Consensus Agreement by August 1 of each year. B. The Association shall receive copies of appropriate new or modified fiscal, budgetary or construction programs at such times as they are transmitted to Board members for final actions. C. All other information requested from the District will be provided to the Association in a timely manner.

The District also agrees to provide the REA with pertinent financial and staff information needed by the Association to develop constructive Meet & Confer proposals. The REA President will be provided with a current policy manual and administrative rules, regulations, and directives by July 1 of each year. District Information. The district agrees to furnish monthly to the exclusive representative and to each building lounge the same information as each board member receives in the board book. Additional information of a public nature will be made available to the exclusive representative for its perusal in accordance with the right extended to any citizen.
District Information. The Board’s polices are recognized as being of vital concern to employees affected by them. Consequently, for actions concerning policies not covered in this Agreement which affect employees covered by this Agreement, the District’s Administration shall inform the Association at a reasonable time prior to the initiation of such change, in order to provide time for the Association to consult with its members.

Individual unit members, upon request, shall be provided with a hard copy. 3.5.1.1 The District shall provide the Association upon request an updated electronic copy of the current Collective Bargaining Agreement. 3.5.2 The District shall provide the Association with an electronic copy of all Board agendas, including any and all back-up information accompanying each agenda. 3.5.3 Upon request, the District will furnish to the Association non-confidential information relating to the employer-employee relations, salaries, budget, District finance and other available and appropriate non-confidential information that is necessary to the Association in fulfilling its role as the exclusive bargaining agent. 3.5.4 The District shall provide the Association upon request a list of all bargaining unit members approved for any type of leave as well as a list of all bargaining unit members hired on a temporary contract for the same. 3.5.5 The District shall provide the Association upon request a list of all bargaining unit members in temporary assignments, including name, position, worksite, and length of contract.
