Disability Retirement Dispute Resolution Procedure. A. When a safety member of the Retirement System applies for a disability retirement, and the Board of Administration ("Board") of the California Public Employees' Retirement System ("CalPERS") requests the City to determine whether the applicant is incapacitated for the performance of duty, the City shall promptly perform all acts necessary, including the conduct of a medical examination, to determine whether the applicant is incapacitated for the performance of duty. The determination of the City shall include an explanation of the basis for that decision. If the City has not made that determination within 180 calendar days from the date of the Board's request, it shall be deemed to have determined that the applicant is incapacitated for the performance of duty.
