Design Information. The Company's drawings, details, etc If, and to the extent, that the Contractor is entitled to information, drawings, details and documents from the Company pursuant to the Contract, and the same is necessary in order to enable the Contractor to comply with the Contract, the Contractor shall notify the Company timeously setting out details of the information required and the time by which it is reasonably necessary to receive the same. Condition Precedent Notice It shall be a condition precedent to the Contractor's right to rely upon the Company's failure to provide such necessary information, drawings, details and documents as are required by the terms of the Contract that the Contractor shall have complied with the requirements of clause 2.1. Submission of drawings etc The Contractor shall submit to the Company such information, drawings, details and documents as are required by the Contract and/or as necessary in order to enable the Contractor to execute and complete the Contract Works ("Design Information"), sufficiently prior to the commencing of the relevant parts of the Contract Works, having regard to the timing and sequence of the Project, the Contract Works and the requirements of this clause 2. Approval/ Disapproval of drawings etc The Company shall designate the Design Information as follows: "A" Proceed, with no comment; "B" Proceed, but take note of comments made; "C" Rejected. Must be resubmitted. If the Company fails to respond within 14 days of the date of receipt of any Design Information, then provided that the Contractor shall have made reasonable enquiries to establish the Design Information was received by the Company they shall be deemed to have an "A status" under clause 2.4 Proceeding with the Contract Works The Contractor shall not proceed with the relevant part of the Contract Works until all of the relevant Design Information has received "A" or "B" status under clause 2.4. Effect of approval and/or comments No approval or comment of the Company under clause 2.4 hereof shall in any way relieve the Contractor of its obligations to carry out and complete the Contract Works in accordance with the Contract, or in any way relieve the Contractor from its responsibility for the same.
