Common use of Deployment Rotation Clause in Contracts

Deployment Rotation. 1. Deployment rotation will be initially determined by a seniority list for fire season 2015. Seniority for the purpose of this list will be defined as time in class as a Food Service Coordinator. This list will rotate according to the guidelines below. When and if a new person is added to the list, they will be inserted into the list according to their seniority. The list will be carried over from year to year. 2. In the event of staff refusal to deploy, he/she will move to the bottom of the rotation. 3. The Institution will call the employee’s contact number when they are on scheduled vacation leave. If the employee does not answer the call or reuses to be deployed they will be moved to the bottom of the list. 4. Staff calling in sick for any reason will be ineligible to deploy until the end of their regularly scheduled shift. If the employee is contacted and offered to deploy after their regularly scheduled shift but prior to midnight and refuse due to illness, staff will maintain their position on the list. 5. Total duration of any deployment will not affect or change the rotation. 6. If there is a mistake in the deployment rotation, the sole and exclusive remedy shall be, at the employee’s choice, to either: 1) place the employee who was not initially deployed to be placed at the top of the deployment rotation list regardless of the length of the deployment, or, 2) the employee not initially dispatched will be dispatched to the fire assignment to replace the employee who was initially dispatched. The employee shall notify the Institution in writing which option they will exercise. Any dispute caused by a mistake in the deployment rotation shall not be subject to the grievance procedure.

Employees with approved time trades pending during a deployment both Parties must agree to change the trade dates or cancel the trade. If the employee fails to rectify pending time trade agreements within one (1) hours of being contacted about a fire crew assignment they will forfeit their turn to be deployed and will be moved to the bottom of the list.
