Common use of Deferral of Process Clause in Contracts

Deferral of Process. 1. If disciplinary proceedings are in progress at the same time as the pre- tenure faculty member is being considered for tenure or intermediate review, the employer or employee may request that the Vice-Xxxxxxx, Faculty Affairs defer the process until a decision has been taken whether to impose discipline. In cases of tenure consideration, the Vice-Xxxxxxx, Faculty Affairs may extend the employee's contract by the length of the deferral where necessary to allow for completion of the tenure process.
