Common use of Declining Overtime Clause in Contracts

Declining Overtime. Employees may decline overtime on a seniority basis providing there are other qualified employees available to perform the work. In such cases, the junior employees cannot decline to work overtime. However, it is recognized that as much as possible, overtime will be distributed fairly and equally amongst all employees.
