Declaration of Easements, Covenants and Restrictions. Seller has recorded with the Cuyahoga County, Ohio Recorder’s Office a Declaration of Easements, Covenants and Restrictions (“Declaration”) encumbering the real property comprising the Maypine Estate Subdivision, including, without limitation, the Property. The Declaration shall, among other things, include: (a) certain terms and conditions applicable to the formation and governance of the Maypine Estate Subdivision Homeowners’ Association (the “Association”) and (b) certain restrictions and covenants which are customary for subdivisions of similar character. The Declaration will be provided to Buyer prior to the expiration of the due Diligence Period.
