Common use of Date of Termination Clause in Contracts

Date of Termination. “Date of Termination” means the date of receipt of the Notice of Termination or any later date specified therein, as the case may be; provided, however, that (i) if the Executive’s employment is terminated by the Company other than for Cause or Disability, the Date of Termination shall be the date on which the Company notifies the Executive of such termination and (ii) if the Executive’s employment is terminated by reason of death or Disability, the Date of Termination shall be the date of death of the Executive or the Disability Effective Date, as the case may be.

Date of Termination. “The "Date of Termination” " means the date of receipt of the Notice of Termination or any later date specified therein, as the case may be; provided, however, that (i) if the Executive’s employment is terminated by the Company other than for Cause or Disability's death, the Disability Effective Date of Termination shall be or the date on which the termination of the Executive's employment by the Company notifies for Cause or without Cause or by the Executive of such termination and (ii) if the Executive’s employment for Good Reason or without Good Reason is terminated by reason of death or Disability, the Date of Termination shall be the date of death of the Executive or the Disability Effective Date, as the case may beeffective.

The “Date of Termination” means the date of receipt of the specified in a Notice of Termination pursuant to paragraph 3 hereof, or any later date specified therein, as the case may be; provided, however, that (i) if the Executive’s employment is terminated by last date as an active employee of the Company other than for Cause or and its affiliates before a termination of employment due to death, Disability, the Date of Termination shall be the date on which the Company notifies the Executive of such termination and (ii) if the Executive’s employment is terminated by reason of death or Disability, the Date of Termination shall be the date of death of the Executive or the Disability Effective Dateother reason, as the case may be.

Date of Termination. “Date of Termination” means the date of receipt of the Notice of Termination or any later date specified therein, as the case may be; provided, however, that " shall mean (i) if the Executive’s 's employment is terminated by FECI due to the Company other than for Cause or Executive's Disability, the Date of Termination shall be the date on which the Company notifies the Executive of such termination and Disability Effective Date, (ii) if the Executive’s 's employment is terminated by reason of death or Disabilitythe Executive's death, the Date of Termination shall be the date of death of the Executive Executive, and (iii) in all other cases, the date of receipt of the Notice of Termination or the Disability Effective Dateany permitted later date specified therein, as the case may be.

Date of Termination. “Date of Termination” means (i) if Employee’s employment is terminated for any reason other than Employee’s death, the termination date of receipt of set forth in the Notice of Termination written notice to that effect given by Employee to the Company or any later date specified thereinby the Company to Employee, as the case may be; providedbe (taking into account any notice or cure period required hereunder), however, that (i) if the Executive’s employment is terminated by the Company other than for Cause or Disability, the Date of Termination shall be the date on which the Company notifies the Executive of such termination and (ii) if the ExecutiveEmployee’s employment is terminated by reason of death or Disability, the Date of Termination shall be the date of death of the Executive Employee or the Disability Effective Date, as the case may be.
