Common use of Date of Commencement Clause in Contracts

Date of Commencement. The Work shall commence upon Design-Builder’s receipt of Department’s Notice to Proceed or the date set forth in the Notice to Proceed (“Date of Commencement”), unless the parties mutually agree otherwise in writing. The Department will issue a Notice to Proceed within fifteen (15) days after the Agreement Date, unless the parties mutually agree otherwise in writing.
