County's and City’s Remedies. If conditions or circumstances, including but not limited to a Default as set forth in Section H exist, County or City shall have all rights and remedies available at law and equity under the Agreement, specifically including the right to terminate the Agreement, the right to pursue Contractor for damages and the right of Emergency take-over as set forth in Section J. All County's or City’s remedies shall be cumulative and shall be in addition to any other remedy available to the County or City.

  • City’s Remedies In the event that Developer is in default under this Agreement, and Developer thereafter fails to cure any such default within the time period described above, then, in that event, in addition to all other legal and equitable remedies which City may have, City may terminate this Agreement by written notice delivered to Developer.
