Common use of CONTINGENT FEE Clause in Contracts

CONTINGENT FEE. Consultant warrants, by execution of this Agreement that no person or selling agency has been employed, or retained, to solicit or secure this Agreement upon an agreement or understanding, for a commission, percentage, brokerage, or contingent fee, excepting bona fide employees, or bona fide established commercial or selling agencies maintained by Consultant for the purpose of securing business. For breach or violation of this warranty, County has the right to annul this Agreement without liability; pay only for the value of the work actually performed, or in its discretion to deduct from the contract price or consideration, or otherwise recover the full amount of such commission, percentage, brokerage, or contingent fee.

CONTINGENT FEE. Consultant CONSULTANT warrants, by execution of this Agreement AGREEMENT, that no person or selling agency has been employed, employed or retained, retained to solicit or secure this Agreement AGREEMENT upon an agreement or understanding, for a commission, percentage, brokerage, brokerage or contingent feecontingent, excepting bona fide employees, employees or bona fide established commercial or selling agencies maintained by Consultant the CONSULTANT for the purpose of securing business. Consultant Engineer warrants, by execution of this Agreement contract that no person or selling agency has been employed, or retained, to solicit or secure this Agreement contract upon an agreement or understanding, for a commission, percentage, brokerage, or contingent fee, excepting bona fide employees, or bona fide established commercial or selling agencies maintained by Consultant Engineer for the purpose of securing business. For breach or violation of this warranty, County Owner has the right to annul this Agreement contract without liability; pay only for the value of the work actually performed, or in its discretion to deduct from the contract price or consideration, or otherwise recover the full amount of such commission, percentage, brokerage, or contingent fee.

CONTINGENT FEE. Consultant warrantswarrants that it has not employed or retained any company or person, by execution of this Agreement that no person or selling agency has been employed, or retainedother than a bona fide employee working for Consultant, to solicit or secure this Agreement upon an agreement Contract, and that it has not paid or understandingagreed to pay any company or person, for other than a bona fide employee, any fee, commission, percentagepercent, brokeragebrokerage fee, gift, or any other consideration, contingent fee, excepting bona fide employees, upon or bona fide established commercial resulting from the award or selling agencies maintained by Consultant for the purpose of securing businessmaking this Contract. For the term of this Agreement, no director, official, officer or employee of City, during the term of his or her service with City, shall have any direct interest in this Agreement, or obtain any present or anticipated material benefit arising therefrom.

CONTINGENT FEE. For breach or violation of this warranty, County has the right to annul this Agreement Contract without liability; pay only for the value of the work actually performed, or in its discretion to deduct from the contract Contract price or consideration, or otherwise recover the full amount of such commission, percentage, brokerage, or contingent fee.
